These Terms govern your access to and use of UnboundLabs.ai. By accessing or using the Service, you agree to be bound by these Terms and applicable law.

1. Scope and Acceptance

Welcome to UnboundLabs.ai (the "Site", "Service", "we", "us", or "our"). These Terms of Service (the "Terms") form a legally binding contract between you ("you" or the "User") and us.

By accessing, browsing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by applicable laws and regulations. If you do not agree, you must not use the Service.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) and have legal capacity to enter into these Terms.

  • You affirm that you are the person depicted in every image or video you upload for personal likeness-based generation features.
  • You must not upload content depicting other individuals for AI processing without explicit, verifiable consent and a valid legal basis.

3. User Accounts and Security

You may need to create an account to access parts of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must promptly notify us of any unauthorized access to or use of your account.

4. Service Description

The Service enables Users to upload inputs and generate AI-assisted media outputs ("AI-Generated Content"). Features may include account tools, storage, template-related functions, payments, and related support services. We may improve, modify, or discontinue features from time to time.

5. User Content

"User Content" means all images, videos, text, prompts, data, audio, or other materials that you upload, transmit, or otherwise make available through the Service.

5.1 Your Representations

By submitting User Content, you represent and warrant that:

  • You own or control all rights necessary to submit and process the User Content;
  • The User Content does not infringe, misappropriate, or violate intellectual property, privacy, publicity, or other third-party rights; and
  • The User Content complies with these Terms, including Section 5.3 (Prohibited Content).

5.2 License to Us

You grant us a limited, non-exclusive, royalty-free license to host, store, reproduce, modify, adapt, create derivative works (including AI-Generated Content), and otherwise use User Content solely for operating, securing, supporting, and improving the Service, including compliance and abuse prevention.

Important: We do not sell your User Content or AI-Generated Content. Content is processed to provide the Service and related operational functions.

5.3 Prohibited Content

You must not upload, generate, or distribute content through the Service that:

  • Depicts minors;
  • Depicts any person without explicit, verifiable consent and legal permission;
  • Promotes violence, terrorism, hate, or self-harm;
  • Is unlawful, defamatory, fraudulent, deceptive, or otherwise abusive;
  • Infringes third-party rights; or
  • Violates applicable law or regulation.

Where legally permitted, adult-oriented content involving only lawful and consenting adults may be allowed, subject to these Terms and all applicable laws. You remain fully responsible for any sharing or publication.

6. AI-Generated Content

AI-Generated Content is produced algorithmically and may contain artifacts, inaccuracies, distortions, or unexpected outputs. We do not guarantee that AI-Generated Content is accurate, realistic, uninterrupted, or fit for a particular purpose.

You acknowledge that generated outputs may unintentionally include sensitive or offensive elements, and you assume the risks associated with use, publication, and downstream distribution.

  • Subject to your compliance with these Terms and payment of applicable fees, you receive rights in AI-Generated Content specifically created for you, excluding underlying models, software, and platform technology.
  • You are solely responsible for all AI-Generated Content generated from your uploads, including any sharing, publication, or other use.

7. Intellectual Property Rights

All intellectual property rights in the Site, Service, underlying models, software, trademarks, and logos remain our exclusive property or the property of our licensors.

Nothing in these Terms grants you a right to use our trademarks, trade names, or branding without prior written authorization.

8. Fees and Payment

If paid tiers, subscriptions, or credits are offered, you agree to pay all applicable fees in accordance with pricing and billing terms shown at checkout or in the Service interface.

Unless required by mandatory law, fees are non-refundable.

8.1 Refund Policy

Except where non-waivable consumer rights require otherwise, we do not provide refunds for:

  • Purchased credits, whether used or unused;
  • Subscription fees or other service payments; and
  • Credits consumed for AI-Generated Content, regardless of outcome quality.

Once credits are consumed to generate content, they are treated as used. Output quality may vary due to the probabilistic nature of AI systems.

9. Creator Rewards and Payouts

  • Reward Policy Changes: We may establish, modify, suspend, or discontinue reward rules and formulas at any time.
  • Reward Calculation and Display: Dashboard values are informational and may be verified, adjusted, delayed, or corrected based on our internal records.
  • Payout Schedule: Payouts may be processed periodically and may be delayed or held for review where irregularities are suspected.
  • Transaction Fees: You bear transaction-related costs, including bank, processor, network, or transfer fees.
  • Currency and Exchange: Conversions are performed using methods and rates determined by us or payment partners; exchange fluctuations are your responsibility.
  • Tax Responsibility: You are solely responsible for your tax obligations related to rewards and payouts.
  • Fraud and Abuse: We may suspend, revoke, offset, or claw back rewards for suspected fraud, abuse, or manipulation.
  • Program Discontinuation: We may suspend or terminate reward programs at any time, subject to mandatory law and valid accrued amounts.

10. Copyright, Privacy, and Content Complaints

We respect intellectual property rights and the personal privacy of all individuals. We maintain a strict zero-tolerance policy against the generation, upload, or distribution of Non-Consensual Intimate Imagery (NCII) and the unauthorized use of any person's likeness.

Reporting Violations:
If you believe your copyright has been infringed, or if you believe your image, likeness, or personal information has been used to generate or share content on our Service without your explicit consent, please immediately contact us at info@unboundlabs.ai with the subject line "Urgent: Content Takedown Request".

To enable us to investigate and take swift action, your notice must include:

  • A description of the copyrighted work, privacy violation, or unauthorized use of likeness;
  • Sufficient details to locate the specific material on our Service (such as URLs, file names, or specific generation timestamps);
  • A statement that you have a good faith belief that the use of the material is not authorized by the intellectual property owner, the individual depicted, or the law; and
  • A statement that the information in your notice is accurate and that you are the rights owner, the depicted individual, or legally authorized to act on their behalf.

Upon receiving a substantiated complaint, we reserve the right to immediately remove or disable access to the offending content. We actively enforce a repeat-infringer policy and will suspend or permanently terminate the accounts of Users found to be violating these rules, without prior notice or refund.

11. Disclaimers

THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT TO THE EXTENT PERMITTED BY LAW.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE.

Specific Limitation of Liability for Users in the EU: Notwithstanding the foregoing, if you are a consumer residing in the European Union, the following shall apply: We shall be liable without limitation for damages resulting from injury to life, body, or health, as well as for damages caused by our intentional misconduct or gross negligence, including that of our legal representatives or vicarious agents. In cases of slight negligence, we shall only be liable for the breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on the observance of which the User may regularly rely. In such cases, our liability is limited to the foreseeable, typically occurring damage. Mandatory statutory liability, such as under applicable product liability laws, remains unaffected.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by mandatory law.

13. Indemnification

You agree to indemnify and hold us harmless from claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from:

  • Your User Content;
  • Your use of the Service;
  • Your breach of these Terms; or
  • Your violation of law or third-party rights.

14. Termination

We may suspend or terminate access to the Service at any time, with or without notice, where we believe conduct violates these Terms, applicable law, platform security, or rights of others.

Rights and obligations that by their nature should survive termination remain in effect after termination.

15. Modifications

We may revise these Terms from time to time. Material changes will be posted on this page and, where appropriate, communicated through the Service or by email.

Continued use of the Service after revised Terms take effect constitutes acceptance of the revised Terms.

16. Governing Law and Dispute Resolution

These Terms are governed by the law applicable at our principal place of business, excluding conflict-of-law principles and excluding the UN Convention on Contracts for the International Sale of Goods (CISG), where applicable.

If you are a consumer in the EU or another jurisdiction with mandatory protections, your mandatory statutory rights remain unaffected.

Disputes should first be addressed through good-faith negotiations. If no amicable resolution is reached, statutory jurisdiction rules apply.
